- Могут ли традиционные правовые конструкции быть адаптированы к реалиям цифровой экономики или необходима разработка принципиально новых законов?
- Как может быть выстроена модель универсализации права транснациональных технологий?
Решение первого вопроса напрямую зависит о того, как современная юриспруденция будет оценивать правосубъектность и охраноспособность цифровых технологий. Как показало проведенное исследование, маргинализация традиционного права в свете развития цифровых технологий налицо, а потому использование старых конструкций может привести лишь к мозаичному регулированию без резервов для дальнейшей адаптации.
Поступательное развитие цифровой экономики невозможно без разработки и принятия принципиально новых правовых конструкций с запасом прочности на перспективу. В частности, в кардинальном пересмотре нуждаются вопросы о правосубъектности технологий, авторском и смежном праве, ответственности машин и страховании. Важно также отметить, что разработка этих моделей должна вестись на уровне не отдельного государства, а международного сообщества для обеспечения универсализации права.
